Terms of Service

  1. Introduction
    • These Terms of Service ("Terms") govern the conditions for the use of all services (collectively, the "Services") provided via the website "ShindanMaker shindanmaker.com" ("Website"), as managed by the ShindanMaker administrative team ("Administrators"), between the Administrators and a user of the Services.
  2. Consenting to the Terms
    1. Your use of the Services must be in accordance with the conditions set forth by these Terms.
    2. If you are a minor, please use the Services only with the consent of a parent or legal guardian who has reviewed the contents of these Terms.

      5. Conduct involving the defamation, harassment, or slander of any other person
      6. Conduct involving any criminal threat or the use of any other expression that contains antisocial content or causes discomfort to any other person
      7. Conduct involving the high-volume or repeated submission of identical or similar content, or any other conduct judged by the Administrators to constitute trolling or spamming
      8. Conduct involving the use within Submitted Content of any expression containing content that coincides with the personal information of any other existing person, such as telephone number, address, or email address, and which may constitute harassment of any other person
      9. Conduct involving the direction of any other user to any website containing malicious software, or on which information that violates any law or ordinance; information regarding pornography or adult entertainment, etc.; information that contravenes social standards; or information that may adversely affect minors, etc., is published
      10. Conduct involving the fraudulent manipulation of the Services' ranking feature, search feature, or display feature
      11. Conduct involving interference with the Services' servers or networks, improper manipulation of the Services with the use of scripts or other technological means, deliberate use of any bugs found within the Services, or any other conduct that interferes with the administration of the Services or other users' use of the Services or causes difficulty for the Administrators or any other user
      12. Conduct involving the use of the Services with another account after being banned from using the Services due to prohibited conduct
      13. Any other conduct judged by the Administrators to be inappropriate
  7. Measures for Dealing with Prohibited Conduct
    1. In the event that you have engaged in prohibited conduct as defined by these Terms, the Administrators may take measures including the suspension of your eligibility to use the Services, the restriction of your access to the Services, or the de-listing, deletion, or filtering of your Submitted Content without notice.
    2. In the event that your privileges as a user of the Services have been suspended, your suspension may be lifted following the deletion of the Submitted Content that was in violation.
  8. Your Responsibilities
    1. You will supply the products and services that you require in order to use the Services (telecommunications equipment, software, bandwidth) at your own expense and as a matter of your own responsibility. The Administrators bear no responsibility for, and will be not involved in any way with, the products and services that you require in order to use the Services.
    2. You use the Services at your own risk, and bear all responsibility in relation to all actions that you take in connection with the Services and the results of said actions.
  9. Restitution
    • In the event that the Administrators have suffered damages as a result of your violation of these Terms, the Administrators may demand restitution for said damages. You will be required to respond to any such demand immediately.
  10. Management of Personal Information
    • Any personal information that the Administrators have received from you in the course of your use of the Services will be managed in accordance with ShindanMaker's "Privacy Policy."
  11. Property Rights
    1. All property rights relating to the information, services, and software included in the Services will belong to the Administrators.
    2. You will own the copyright for any Submitted Content that you have posted or uploaded with the use of the Services. However, the nature of the Services is such that text and images that are automatically generated from said Submitted Content by way of the programming of the Services may be used by the Administrators or other users for the purpose of introducing readers, on the Website or on SNS (social media), etc., to the Submitted Content. By using the Services, you consent to this use of your Submitted Content.
    3. In the event that you would like to reuse or otherwise use for any purpose any other user's Submitted Content, you must negotiate directly with the user who has submitted said content for that user's consent. The Administrators will not act as intermediaries. If you do not know the account name of the user who has submitted the content in question, you will be unable to negotiate through the Services.
  12. Disclaimer
    1. The Administrators will endeavor to the best of their ability to ensure that the Services are provided to all users in a secure and stable manner. However, the Administrators bear no responsibility of any kind for any damages that any user or other party may suffer that have been caused by the Services, except in cases of intent or gross negligence on the part of the Administrators.
    2. The Administrators are under no obligation to monitor Submitted Content on the Services.
    3. In the event that any other user or party has suffered damages as a result of content that you have submitted, you will bear all responsibility for said damages. The Administrators bear no responsibility, except in cases of intent or gross negligence on their part.
    4. In the event that a dispute has arisen between users, or between a user and a third party, the dispute will be resolved by the parties involved. The Administrators will not act as intermediaries.
    5. The Administrators may suspend or terminate the operation of the Services or delete or alter the information published on the Website, in part or in whole, without notice.
  13. Applicable Laws and Court of Jurisdiction
    • These Terms are governed by the laws of Japan. The Tokyo District Court will have exclusive jurisdiction in the first instance.
  14. Exceptions
    • In the event that a provision on any page of the Website conflicts with these Terms, the provision published on said page will apply.
